DuitNow Terms and Conditions
1. Overview
1.1 In this DuitNow Terms and Conditions (“Terms and Conditions”), references to “You”, ”Your” and “Yours” refers to the customers who are utilising the DuitNow service and has an account with KAF Digital Bank Berhad (Company No. 202301012417 (1506339-M)) and references to “We”, “Our”, “Ours” and “Us” refer to KAF Digital Bank Berhad.
2. Definitions & Interpretations
2.1 The following terms and expressions shall apply to this Terms and Conditions, unless the context requires otherwise:
“Banking Services” means the facilities, products and services of KAF Digital Bank Berhad that are made available to You that can be accessed through the Mobile Application.
“BNM” means Bank Negara Malaysia, the Central Bank of Malaysia.
"Business Day" means any day from Monday to Friday on which the Bank is open for business in Malaysia but does not include any public holiday.
“Debit Card-i” means any Debit Card-i issued by the Bank to the Customer providing electronic access to the Customer’s Islamic Deposit Account, and to allow the Customer to effect any transactions subject to the Bank's Debit Card-i
"DuitNow” means an overlay service of Retail Payment Platform (as defined below) which allows You to initiate and receive credit transfer.
“DuitNow ID” means an identifier of an account holder such as a mobile number, NRIC, passport number, army number or police number (in the case of an individual) or business registration number (in the case of a corporate customer) or any other identifiers as may be introduced by the DuitNow Operator from time to time.
“DuitNow Operator” means Payments Network Malaysia Sdn. Bhd. (Company No.: 200801035403 [836743-D]).
“Islamic Deposit Account” means the Shariah-compliant Savings Account-i (SA-i) offering Malaysian Ringgit to the Customer which may be accessed through the Mobile Application, subject to the Bank’s Islamic Deposit Account Terms and Conditions.
“Look-up Request” means request(s) made by You in order to access the DuitNow service through the Mobile Application.
“Mobile Application” means the Banking Services provided by the Bank through the Mobile Application Account downloaded and installed by You.
“Mobile Application Account” means an account governing Mobile Application that is linked to the Islamic Deposit Account, Debit Card-i and all other services and products offered by the Bank from time to time.
“NAD” means the National Addressing Database which is a central depository established by PayNet which links a bank account to a recipient’s DuitNow ID and facilitates payment to be made by referring to Your DuitNow ID.
“PayNet” means Payments Network Malaysia Sdn. Bhd.
“Pay-to-Account” means the account which funds will be transferred.
“Pay-to-Proxy” means a mechanism which allows companies to send funds to individuals and other businesses on a real-time basis, without the need for naming a beneficiary bank or any details of the account.
“Personal Data” means any information in respect of commercial transactions that relate directly or indirectly to a You, who are identified or identifiable from that information which includes, but not limited to, the your name, address, identification card number, passport number, banking information, email
address and contact details.
“Retail Payment Platform” means the shared payment infrastructure developed and operated by PayNet which facilitates payments and collections addressed using easily remembered proxies or by account numbers.
“Shariah” means Shariah principles as determined from time to time by the rulings of the Shariah Advisory Council of BNM and the Shariah Committee of the Bank. You and KAF Digital Bank Bhd agree that their respective rights and obligations herein are intended to be and in conformity with the Shariah as determined from time to time by the rulings of Shariah Advisory Council of BNM and the Shariah Committee of the Bank.
2.2 In the event of any conflict in the interpretation and translation of this Terms and Conditions in any language, the English version of this Terms and Conditions shall prevail.
3. Introduction
3.1 This Terms and Conditions apply and regulate Your use of the DuitNow service made available by Us. The DuitNow service allows You to transfer an amount specified by You from Your designated bank account maintained with Us, to a bank account maintained by Your recipient at a participating DuitNow participant via Pay-to-Account number and Pay-to-Proxy (Pay via DuitNow ID), or such other means as prescribed by Us or the DuitNow Operator from time to time.
3.2 The DuitNow services made available by Us is part of the services under KAF Digital Bank Bhd, and accordingly, this Terms and Conditions are in addition to and shall be read in conjunction with KAF Digital Bank Bhd’s Mobile Application Terms and Conditions. Any use of the DuitNow services and acceptance of this Terms and Conditions by any other person(s) or user(s) authorised by You for the purposes of the Mobile Application shall be deemed as Your use of the Mobile Application and Your acceptance of this Terms and Conditions.
4. DuitNow Services
4.1 In order for You to receive funds via DuitNow, You must first register at the Mobile Application.
4.2 If You wish to send funds via DuitNow, You must first initiate a payment by entering the recipient’s DuitNow ID in the Mobile Application
4.3 We will perform a ‘Look-up Request’ to verify the recipient’s registration of the DuitNow ID in NAD and if the recipient is registered, We will display the name of such registered DuitNow recipient.
4.4 You are responsible for the correct entry of the recipients DuitNow ID and ensuring that the recipient’s name displayed is the intended recipient of the funds prior to confirming the DuitNow transaction.
4.5 We will notify You on the status of each successful, failed or rejected DuitNow transaction via the Mobile Application.
4.6 You acknowledge and agree that We shall have no duty to and shall not be required to take any steps to verify or seek any other confirmation from any party as to whether such registered recipient is the intended recipient, and We shall not be liable for transferring the funds to such registered recipient even if such person is not the intended recipient.
4.7 Pursuant to Clause 4.5 above, You agree and understand that once a DuitNow transaction has been confirmed, it will be deemed irrevocable and You will not be able to cancel, stop or perform any changes to that DuitNow transaction.
4.8 The DuitNow service shall not be used for any Shariah non-compliant activities.
5. Multiple Look-Up Requests
5.1 You are advised not to submit multiple “Look-Up Requests” to Us without a confirmed DuitNow transaction, be it the status of “successful”, “pending” or “rejected”. We shall not display the results of the “Look-Up Requests” upon five (5) times consecutive Look-Up Requests that are not followed with a confirmed DuitNow transaction.
5.2 Without prejudice to any of Our rights and remedies, We reserve the right to terminate or suspend Your access to and use of the DuitNow service in the event We consider in Our absolute and sole discretion that inappropriate, fraudulent or suspicious use is being made of the DuitNow services, such as where multiple “Look-Up Requests” are submitted without a confirmed DuitNow transaction. You are advised to contact Our Contact Centre should you encounter any issues relating to the foregoing.
6. Recovery of Funds
6.1 You have rights in relation to the investigation and recovery of erroneous payments, fraudulent and unauthorised DuitNow transaction made from Your account and We will investigate and provide the relevant advice to You pursuant to this clause.
7. Erroneous DuitNow Transaction
7.1 If You have made an erroneous DuitNow transaction, You may request for recovery of the funds within ten (10) Business Days from the date the erroneous DuitNow transaction was made and We will work with the affected recipient’s bank to return the said funds to You within seven (7) Business Days provided the following conditions are met:
(a) The funds were actually wrongly credited into the affected recipient’s account;
(b) If funds have been wrongly credited, whether the balances in the affected recipient’s account is sufficient to cover the funds recovery amount;
(c) If the balances are sufficient to cover the recovery amount, the erroneously credited funds may be recoverable; and
(d) If the balances are not sufficient to cover the recovery amount, the erroneously credited funds may not be fully recoverable and the recipient’s bank may partially remit the recoverable fund back to You.
7.2 For any request for recovery of funds between eleven (11) Business Days and seven (7) months from the date the erroneous DuitNow transaction was made, such request shall be subject to the following conditions:
(a) The affected receiving participant is fully satisfied that funds were erroneously credited to the affected recipient; and
(b) Deliver notifications to the affected recipients in writing regarding the funds recovery requests whereby the erroneously credited funds would be recovered through debiting the affected recipients’ accounts within ten (10) Business Days of the notifications unless the affected recipient provides reasonable evidences that the affected recipient is entitled to the funds in question. After fifteen (15) Business Day, if the affected recipients fail to establish their entitlement to the funds, the affected recipient’s bank shall debit the affected recipients’ account and remit the funds back to You.
7.3 For any requests to recover funds after seven (7) months from the date of the erroneous DuitNow transaction, such request shall be subject to the following conditions:
(a) The affected recipient’s bank is fully satisfied that funds were erroneously credited to the affected recipient;
(b) The affected recipient’s bank shall obtain from the affected recipient the decision whether to grant consent within ten (10) Business Days; and
(c) Once consent is obtained, the affected recipient’s bank shall debit the affected recipient’s account and remit the funds back to You within one (1) Business Day.
8. Unauthorised or Fraudulent DuitNow Transaction
8.1 For DuitNow transactions which are not authorised by You or which are fraudulent, We will, upon receiving a report from You alleging that an unauthorised or fraudulent DuitNow transaction was made, remit the funds back to You provided the following conditions are met:
9. Liability and Indemnity
9.1 You acknowledge and agree that, unless expressly prohibited by any written laws, We and the DuitNow Operator shall not be liable to you or any third party for any direct, indirect or consequential losses, liabilities, costs, damages, claims, actions or proceedings of any kind whatsoever in respect to any matter of whatsoever nature in connection with the DuitNow services offered by Us arising from:
(a) Your negligence, omission, misconduct or breach of any of this Terms and Conditions;
(b) Any erroneous transfer of funds by You, including any transfer of funds to the wrong DuitNow ID, wrong recipient or wrong third party, whether deliberately or otherwise;
(c) Any failure, delay, error or non-transmission of funds due to system maintenance, breakdown or non-availability of any network, software or hardware of the Mobile Application and the DuitNow Operator;
(d) The suspension, termination or discontinuance of the DuitNow services; or
(e) Any unauthorised or fraudulent DuitNow transactions not caused by us or attributable to us.
9.2 You shall indemnify, Us, Our affiliates, and the DuitNow Operator harmless from and against any claims, proceedings, actions, losses, damages, costs (including all legal costs on an indemnity basis), expenses or liabilities, whether foreseeable or otherwise, resulting or arising in connection with any fault, act or omission by You (including but not limited to Your misconduct, breach of any of this Terms and Conditions or negligence).
10. General
10.1 Subject to Shariah, we reserve the right to revise at any time, such charges for the use of the DuitNow services, by providing You with thirty (30) days written notice through the Mobile Application. Such revisions shall take effect from the date stated in the notice. It shall be Your responsibility to be informed of or otherwise seek out any such notice validly posted. Where you continue to access or use the DuitNow services after such notification, You shall be deemed to have agreed to and accepted such revisions to such charges.
10.2 You acknowledge that We may terminate Your use of the DuitNow services with Us for any reason, at any time and without prior notice.
10.3 Subject to Shariah, You acknowledge that We have the right to amend, change, restrict, vary, suspend or modify this Terms and Conditions by providing You with thirty (30) days’ notice through the Mobile Application.
10.4 You consent to the collection, use and disclosure of the Personal Data by Us, Our affiliates, Our service providers and the DuitNow Operator as required for the purposes of the DuitNow services.
10.5 This Terms and Conditions are governed by and shall be construed in accordance with the laws of Malaysia and you agree to submit to the exclusive jurisdiction of the courts of Malaysia.
10.6 If any of the provision in this Terms and Conditions is deemed to be illegal, invalid or unenforceable for any reason, whether in whole or in part, the remaining provisions of this Terms and Conditions are unaffected by the illegality, invalidity or unenforceability, and shall remain in full force and effect to the maximum extent permitted by law.
11. Perbadanan Insurans Deposit Malaysia (PIDM)
11.1 The deposits maintained by the Customer in the Islamic Deposit Account are eligible for protection by Perbadanan Insurans Deposit Malaysia (PIDM) or Malaysia Deposit Insurance Corporation. Coverage of the eligible Islamic Deposit Account balance is subject to these Terms and Conditions as set by PIDM. A copy of the PIDM brochure has been provided to the Customer.
11.2 Subject to the latest version of guidelines by PIDM and any amendment(s) thereof, any deposit will be protected by PIDM up to RM 250,000 for each depositor.
